By accessing or using SpartanComm, a unified communications platform operated by Spartan Media LLC ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Description of Services

SpartanComm provides unified communications services including, but not limited to:

• ·Voice over IP (VoIP) calling via SIP
• ·SMS and MMS messaging
• ·WhatsApp Business messaging
• ·Call recording and management
• ·Customer communication tools and analytics

3. Account Registration

To use our services you must create an account. You agree to:

• ·Provide accurate, current, and complete information during registration
• ·Maintain and promptly update your account information
• ·Maintain the security and confidentiality of your credentials
• ·Notify us immediately of any unauthorized access to your account
• ·Accept responsibility for all activity that occurs under your account

4. Acceptable Use

You agree not to use SpartanComm to:

• ·Send unsolicited bulk messages (spam) or engage in robocalling
• ·Violate any applicable local, state, national, or international law or regulation (including TCPA, GDPR, and CAN-SPAM)
• ·Transmit fraudulent, deceptive, or misleading content
• ·Impersonate any person or entity
• ·Interfere with or disrupt the integrity or performance of the platform
• ·Attempt to gain unauthorized access to our systems

5. SMS Messaging Terms

• ·By providing your phone number, you consent to receive SMS messages from SpartanComm for account verification and service notifications
• ·Message frequency varies based on account activity
• ·Message and data rates may apply
• ·Reply STOP to opt out of SMS communications at any time
• ·Reply HELP for assistance or contact support@espartan.net

6. Payment and Billing

• ·Subscription fees are billed monthly or annually as selected during sign-up
• ·Usage-based charges (minutes, messages) are billed in arrears
• ·All fees are non-refundable except as required by law
• ·We reserve the right to suspend service for non-payment
• ·Prices are subject to change with 30 days' notice

7. Call Recording

You are solely responsible for complying with all applicable laws regarding call recording, including notifying all parties that a call is being recorded. Spartan Media LLC is not liable for any failure to comply with call recording regulations. Call recordings are retained for 90 days by default.

8. Intellectual Property

All content, features, and functionality of SpartanComm — including software, text, graphics, logos, and interfaces — are owned by Spartan Media LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our platform without prior written consent.

9. Disclaimer of Warranties

SpartanComm is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the service is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law, Spartan Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of SpartanComm, even if advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may cancel your account at any time by contacting our support team. Upon termination, your right to use the service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Manassas, Virginia.
